2. Propiedad Industrial (Trademark) 

Khu Khu® is a registered trademark with the European Union Intellectual Property Office (EUIPO), registration number 019251539, and the United Kingdom Intellectual Property Office (UKIPO), registration number UK00004324947.

We assert all legal rights to the Khu Khu name, logo, and brand identity across these territories. Unauthorised use of these marks is strictly prohibited.

 

United Kingdom & EU Design Protection

Following the UK's departure from the European Union, Khu Khu® designs are protected under the following statutory frameworks:

  • Supplementary Unregistered Design (SUD) & Unregistered Community Design (UCD): Our original surface patterns, ornamentation, and overall aesthetic appearance are protected for 3 years from the date of first disclosure in the UK and EU respectively.

  • UK Unregistered Design Right (UKUDR): The three-dimensional shape and configuration of our fan frames and guard ribs are protected for up to 15 years under the Copyright, Designs and Patents Act 1988.

United States Notice (Copyright & Trade Dress)

In the United States, all original artistic patterns, illustrations, and textile designs featured on our products are protected by the U.S. Copyright Act of 1976. These artistic elements are conceptually separable from the functional aspects of the fan and constitute original works of authorship.

Furthermore, the unique "look and feel," including the specific combination of shapes, colours, and design configurations of Khu Khu® fans, constitutes our proprietary Trade Dress under the Lanham Act (15 U.S.C. § 1125(a)). We assert all common law rights in our trade dress and will vigorously defend against any "passing off" or unauthorised use likely to cause consumer confusion.

Global Copyright & Enforcement

Furthermore, all textile prints and hand-painted illustrations are protected by Copyright (Propiedad Intelectual) from the moment of creation. The Titular reserves all rights to pursue legal action against any unauthorised copying, manufacturing, or sale of products that produce the same "overall impression" as a Khu Khu design. We monitor global marketplaces closely and will issue formal takedown notices and seek damages for any infringements.

 

3. EU General Product Safety Regulation (EU) 2023/988 (GPSR)

For customers within the European Union, we comply with the General Product Safety Regulation (EU) 2023/988, effective from December 13, 2024. This includes providing detailed product safety information and ensuring that all products placed on the market are safe under normal or reasonably foreseeable conditions of use.
